Abstract

Background. The subject of the work is the problem of parallel imports under the conditions of such globalization factors as international economic integration, the sanctions regime, and the intensification of international tension. The subject of the work is due to the changing operating conditions of the principle of parallel imports, associated with the consequences of globalization. The relevance of the topic is determined by the strengthening of integration processes and the need to regulate the procedure for cross-border movement of goods containing intellectual property, whose share is growing. The aim of the work is the substantiation of new aspects of the problem of parallel imports in the context of economic integration and the sanctions regime.
Materials and methods. As research methods used comparative, logical, analytical methods, as well as methods of formalization, classification, modeling and forecasting.
Results. The results of the work were provisions on various options for solving the problem of exhaustion of rights in modern conditions. The analysis of existing positions in the field of the problem of parallel imports, the designation of new aspects of its development in the context of the economic unification of states and the formation of a single competitive space made it possible to substantiate the forecasts for solving the problem of exhaustion of rights in modern conditions.
Conclusions. It is concluded that the problem of exhaustion of rights is solved in the context of the optimal balance of interests of authors and other copyright holders, the state, business, and consumers of goods. In the context of Eurasian economic integration, it is justified to use the regional principle of exhaustion of rights that ensures the interests of integration education.
